1. SECURITY.

·These Software and Service Specific Requirements for Fivetran HVR Software (these "Requirements") apply to Customers that have purchased or been granted a license to the Fivetran HVR software solution ("HVR") on the Business Critical Plan or other applicable consumption based pricing plan. These Requirements supplement the terms of the Master Subscription Agreement or other agreement for Customer's use of the Fivetran Products and Professional Services (the "Agreement") entered into between Fivetran Inc. ("Fivetran") and Customer. Capitalized terms used but not defined herein will have the meanings given to them in the Agreement or, if not defined in the Agreement, in the Master Subscription Agreement located at https://www.fivetran.com/legal, or such successor URL as may be designated by Fivetran (the "Fivetran MSA"). For clarity and as used in the Agreement, HVR constitutes "On-Prem Software".

11. SECURITY.

·Notwithstanding anything to the contrary in these Requirements or the Agreement, any security and data processing provisions (including Sections 5.1 and 5.2 of the Fivetran MSA) and any security exhibits related to SaaS Products shall not apply to HVR. Instead, Customer is responsible for the security of its environment as stated in Section 5.3 of the Fivetran MSA.

22. LICENSE KEY.

·Customer must register the HVR hub system with Fivetran. Upon registration, Fivetran will provide a generic license key (not tied to a particular hub) that permits Customer to use HVR as specified in the applicable Order Form. The license key will operate as described in the Documentation found at https://fivetran.com/docs/hvr6/getting-started/licensing.

33. EFFECTIVE DATE AND UPDATES TO THESE REQUIREMENTS.

·These Requirements take effect immediately upon Customer's download of any file necessary to install and configure HVR and apply to Customer's use of HVR. Fivetran may update these Requirements from time to time. Any updates will become effective for Customer upon renewal or entry into a new Order Form granting access to HVR after any updates go into effect. Notwithstanding the foregoing, in some cases (e.g., to address compliance with laws, or as necessary for new features) Fivetran may specify that such updates become effective during Customer's then-current subscription term. Fivetran may provide notice to Customer of any such updates through Customer's account, an email to Customer's email address, an in-product notification or by posting such update on Fivetran's website, and Fivetran will otherwise provide a copy of any such update upon written request by Customer.

44. MISCELLANEOUS.

·Except as otherwise set forth in these Requirements, the terms of the Agreement including, without limitation, any disclaimers, limitations of liability and governing law provisions set forth therein, will apply to Customer's use of HVR.
